This has green coloured tarmac.
Loading and Unloading are NOT allowed, as clearly is therefore parking.
A cycle track is part of the highway for use only by pedal cycles.
A Parking attendant can Issue a PCN (Penalty Charge Notice) under contravention code 49, with a J suffix if enforced by a camera.
Cycle Lane.
This has red coloured tarmac.
A cycle track is not a cycle lane.
A cycle lane is part of the carriageway and is marked by a white line and cycle logos.
Parking in a Mandatory (with yellow lines) cycle lane is a contravention under PCN Codes 01 or 02.
Parking in an advisory cycle lane (with no yellow lines) is not a contravention.
Contravention code 49 applies.
Contravention codes 01 and 02 are the parked and unloading contraventions on a yellow line. An advisory cycle lane can be distinguished from a mandatory lane by the line hatching - an advisory lane has to have a broken white line outside as vehicles are allowed into the lane - either to cross it at a junction or to wait, with a single yellow line. A mandatory cycle lane has to have
a solid white line on the outside to indicate that no vehicles are allowed
into it, excluding emergencies.
Examples
So if a vehicle was is in a red coloured area it had up to 20 minutes(single yellow), 5 minutes(double yellow), observed loading to stay there if there were no kerb markings, indicating a loading/unloading restriction in force. It could stay there all day if there were no yellow lines.
If a vehicle is parked on a Pavement, either within a cycle lane (red), or otherwise, then it can have a PCN issued under contravention code 62 (Vehicle) or 61 (HGV), suffixed by:-
1 One wheel on the footway 2 Two wheels on the footway 4 Four wheels on the footway And others that do not apply to cycle lanes.
The contravention is defined as:- Any vehicle parked wholly or partly on the footway unless signs are present stating that this is allowed
Parking on a footway (62) is considered more serious than a contravention 49 (Cycle path/lane). However, the penalty is the same!
This is not an authourative statement of The Road Traffic Act, it is taken from Training notes for Parking Attendants, and covers the basic criteria a Parking Attendant would be taught during initial training.
